To conduct cassation or reopening trials of legally effective judgments or decisions of provincial / municipal People's Courts, People's Courts of rural districts, urban districts, towns, provincial cities and the equivalent of territorial jurisdiction is protested in accordance with the procedural law.

THE PEOPLE'S COURT OF HO CHI MINH CITY

Organiztional Structure

The People's Court of provinces and municipalities:

a) Judge Committee.

b) Criminal Court, Civil Court, Administrative Court, Economic Court, Labor Court, Family and Juvenile Court.

In case of necessity, the National Assembly Standing Committee decides to set up another specialized Court at the request of the Chief Justice of the Supreme People's Court.

Based on the provisions of this Point and the actual trial requirements in each People's Court of provinces and municipalities, the Chief Justice of the Supreme People's Court decides the organization of specialized Court.

c) Assisting Apparatus.

THE JUDGE COMMITTEE OF THE PEOPLE'S COURT OF PROVINCES AND MUNICIPALITIES

1. The Judge Committee of the People's Court of provinces and municiplaities includes the Chief Justice, the Deputy Chief Justice and a number of judges. The number of members of the Judge Committee shall be decided by the Chief Justice of the Supreme People's Court at the request of the Chief Justice of the People's Court of provinces and municiplaities.

The meeting of the Judge Committee of the People's Court of provinces and municiplaities chaired by the Chief Justice.

2. The duties and powers of the Judge Committee of the People's Court of provinces and municiplaities:

a) Discuss the implementation of programs and work plans of the People's Court of provinces and municipalities.

b) Discuss the report of the Chief Justice of the People's Court of provinces and municipalities with the Supreme People's Court and the People's Council of the same level.

c) Summary of trial experience.

d) Discuss the request of the Chief Justice of the People's Court of provinces and municipalities to the Chief Justice of the Supreme People's Court, the Chief Justice of the Supreme People's Court to review effective sentences and decisions legal force according to cassation and reopening procedures at the request of the Chief Justice.

SPECIALIZED COURT

The duties and powers of specialized Court:

1. First-instance cases according to the provisions of law;

2. Appellate cases where first-instance judgments or decisions have not yet taken legal effect of the People's Courts of provinces and municipalities and the equivalent are appealed or protested against in accordance with the law on prosecution chant.

ASSISTING APPARATUS

1. The Assisting apparatus of the People's Courts of provinces and municipalities including Offices, sections and equivalent units.

2. The Chief Justice of the Supreme People's Court shall decide on the establishment and stipulate duties and powers of the Offices, sections and equivalent units of the Assisting Apparatus of the People's Courts of provinces and municipalities.
